1 – Data controller

Biodata Bank, Inc. registered with the RCS of Colmar, 902 081 116 00011, having its registered office at 15-10 Uguisudanicho, Shibuya, Tokyo 150-0032, Japan, represented by Mr. Takeshi Anzai, as President, is the data controller for the processing of your Personal Data in the context of the Service.

2 – Personal Data collected

For the purposes of this Policy, “Personal Data” has the meaning of Personal Data prescribed under Article 4(1) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of Personal Data (the “GDPR”) and Act No. 78-17 of 6 January 1978 (the “Act”).

The Company may collect Personal Data which are necessary for the operation of the Service. The categories of Personal Data processed are the following:

(1)Information provided by the user. The information provided by the user for or through the use of the Service is as follows:

  • Name, e-mail address and name of company; and
  • Information submitted by the user via input forms or other methods specified by the Company.

(2)Information collected automatically by the Company during user’s use of the Service. The Company may collect information regarding access to or use of the Service, which includes the following.

3 – Legal basis and purposes of the Personal Data processing

On the basis of our legitimate interest, we use your Data for the following purposes:

(1)maintenance, protection and improvement of the Service;

(2)advising and responding to enquiries about the Service, including those received in the contact form; and

dealing with a breach of the Company’s rules, regulations or policies relating to the Service;

4 – Recipients of the Personal Data

Personal Data is processed by the relevant recipients within the Company.

5 – Transfer of Personal Data outside the European Union

Personal Data is transferred to the Controller, based in Japan. These transfers are performed within the framework of the European Commission’s adequacy decision.

6 – Retention period of the Personal Data

We retain your Personal Data no longer than it is necessary for the purposes for which the personal data is processed.

Identification Data such as name, e-mail address, telephone number or postal address is retained for up to three years after receipt.

Data submitted by the user via input forms or other methods specified by the Company are retained for up to three years after receipt.

Data collected automatically by the Company during the user’s use of the Service is retained for up to three years after receipt.

Beyond these periods, the Personal Data may be archived with restricted access for an additional period for limited reasons authorised by law (payment, guarantee, dispute resolution, etc.)

7 – Rights of users

Right of access : You have the right to obtain confirmation as to whether or not your Data is being processed, and if so, to access such Data.

Right to rectification : You have the right to obtain from the Company without undue delay the rectification of your inaccurate Personal Data. In cases where the Company decides not to make such rectification, the Company will inform the user.

Right to erasure : You have the right to obtain from the Company the erasure of your Personal Data without undue delay, subject to our legal retention obligations.

Right to restriction of processing : You have the right to obtain the restriction of the processing when you object to it, when you contest the accuracy of your Data, when you believe that their processing is unlawful, or when you need them for the establishment, exercise or defense of your legal rights. In cases where the Company decides not to carry out such suspension, the Company will inform the user.

Right to object : You have the right to object, on grounds relating to your particular situation, to the processing of your Personal Data by the Company, except in the case of legitimate and compelling reasons of the Company. If you exercise your right to object, the Company will no longer process your Personal Data, unless the Company demonstrates compelling legitimate grounds for the processing which override the interests, your rights and freedoms or for the establishment, exercise or defence of legal claims.

Right to Data portability : You have the right to receive your Data in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller.

Complaints : You have the right to lodge a complaint with a supervisory authority, in France, the CNIL.

Instructions on the management of your data after your death : You have the right to give instructions, general or specific, on the fate of your Personal Data in case of death.

If the Company has reasonable doubts concerning your identity, the Company may request the provision of additional information necessary to confirm your identity.

8 – Exercising your rights

Any request for the exercise of rights should be submitted by email to privacy@biodatabank.co.jp.

9 – Update of this Policy

The Company may amend this Privacy Policy as necessary by simply updating it.
